Terms of Service (ToS)

1. Conditions of Use

The Screeno software is provided to users free of charge. This applies to both private and commercial use within the intended scope.

Any form of redistribution of the software is strictly prohibited. This includes, but is not limited to, resale, sublicensing, rental, mirroring, re-hosting, or uploading the software or its installation files to any third-party platform, server, file-sharing service, or download portal — whether for commercial or non-commercial purposes. The software may only be obtained through the official website of the provider.

2. Warranty and Support

Since the software is provided free of charge ("As-Is"), there is no entitlement to technical support, maintenance, or consultation by the provider.

No assurance is given regarding the availability, error-free nature, or suitability of the software for specific purposes.

3. Disclaimer of Liability

The use of the software is entirely at the user's own risk.

The provider shall not be liable for any damages or problems arising from the installation, use, or malfunction of the software. This specifically includes (but is not limited to) direct damages, indirect consequential damages, loss of data, or business interruptions.

4. Intellectual Property

All rights to the software, including copyrights and trademarks, remain with the provider. The user is only granted a simple, non-exclusive, non-transferable right of use within the scope described in these Terms of Service.

The user is strictly prohibited from reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, or internal structure of the software, except to the extent explicitly permitted by applicable law.

Any modification, adaptation, translation, or creation of derivative works based on the software is prohibited without the prior written consent of the provider.

5. Future Pricing and Version Changes

The current version of Screeno is provided free of charge. However, the provider expressly reserves the right to introduce pricing for future versions or feature sets at any time.

Access to the current free version does not create any entitlement to free access to future versions of the software. Future releases, updates, or successor products may be subject to a separate paid license.

Users will be informed of any such changes via the website or, where an email address has been provided, by email with reasonable advance notice.

6. Permitted Use

The software may only be used for its intended purpose — creating and editing visual mockups and marketing assets. The following uses are explicitly prohibited:

  • Using the software to create content that is illegal, defamatory, or violates third-party rights
  • Automated use, scripting, or integration into pipelines without prior written consent
  • Circumventing any technical protection measures or license enforcement mechanisms
  • Using the software in a manner that could damage, disable, or impair the provider's infrastructure or reputation

7. Termination

The provider reserves the right to terminate or suspend a user's access to the software and related services at any time, without prior notice, if the user violates any provision of these Terms of Service.

Upon termination, all rights granted to the user under these terms cease immediately. The user must stop using the software and delete all copies in their possession.

8. Third-Party Components and Scope of License

The software may incorporate third-party libraries, frameworks, or components ("Third-Party Components"), including commercially licensed software. The license granted to the user under these Terms of Service applies exclusively to the Screeno software itself and does not extend to any Third-Party Components contained within it.

The user receives no rights, licenses, or permissions with respect to any Third-Party Components beyond what is strictly necessary to use the Screeno software as intended. In particular, the user may not extract, isolate, or use any Third-Party Component independently from Screeno.

Each Third-Party Component remains subject to its own respective license terms. The provider has obtained the necessary rights to include such components in the software for distribution purposes, but this does not constitute a sublicense of those components to the end user. The provider makes no warranties with respect to any Third-Party Components.

9. Non-Transferability

The license granted under these Terms of Service is personal and non-transferable. The user may not assign, sublicense, or otherwise transfer their rights or obligations under these terms to any third party without the prior written consent of the provider.

10. Data Protection

The collection and processing of personal data in connection with the use of this website and the software is governed by our separate Privacy Policy. By using the software and this website, the user acknowledges and agrees to the Privacy Policy.

11. Applicable Law and Jurisdiction

These Terms of Service are governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with these terms is Walldorf, Germany, to the extent permitted by applicable law.

12. Language of Contract

The language of this agreement is English. In case of discrepancies between translated versions, the English version shall prevail.

13. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable. If such modification is not possible, the provision shall be severed from these terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

14. Final Provisions

The provider reserves the right to change these conditions at any time or to discontinue the free provision of the software. Users will be notified of material changes via the website or by email if an address has been provided. Continued use of the software after such changes constitutes acceptance of the updated terms.
